Turkey, complying with the European Unions electricity related directives and OECD standards, initiated a major overhaul of the legal and regulatory framework surrounding the electricity industry. The reform program entails liberalization as well as a radical restructuring of the industry, that is, its generation, transmission and distribution segments, including wholesale and retail activities.
Restructuring process has started with the establishment of the Energy Market Regulatory Authority (EMRA) upon law no. 4628 which came into force on 3 March 2001. The ruling instrument of EMRA, Energy Market Regulatory Board was commissioned on November 19, 2001. EMRA has adopted hundreds of regulations setting out the principles of the functioning of the market, comprising generation, transmission, distribution and trade of electricity and has introduced mechanisms and instruments to conduct the activities in the market.
The new regime provides entry opportunities into generation, wholesale trade, distribution, retail trade, and import-export of electricity. However doing business in the sector entails being up to date in respect of rather complex rules and regulations as well.
